Terms of Service

These terms are an agreement between you and Santa Caught on Camera ("we", "us") for using this website (the "Service"). By creating an account, uploading a photo or buying credits, you agree to them. If you don't agree, please don't use the Service.

1. Who can use it

You must be at least 18 years old. The Service is for parents and other adults making videos for children; children should not use it themselves. You're responsible for your account and everything done with it, so keep your sign-in details safe.

2. What the Service does

You upload a photo of a room, type a child's first name, choose a good deed, and our AI providers make a short video in which Santa Claus appears in that room and says the name. The free preview is a still image; the video is what you pay for.

The videos are made with AI. They are not real footage of anyone. AI output can be imperfect: the room may change slightly, Santa's movements or timing may vary, and unusual names may be pronounced wrong (see the Refund Policy for free redos). Generation usually takes a few minutes but can take longer.

3. What you may upload and ask for

Before each preview or video, you confirm that the room is your home or you have permission to photograph it, and that you're 18 or older. You may not use the Service to:

• upload photos of people, especially children, or of anyone who hasn't agreed;
• make Santa say anything offensive, hateful or harassing (names are checked, and good deeds come from a fixed list);
• deceive, frighten, bully or embarrass anyone, or pass a video off as real news or evidence;
• break any law or anyone else's rights, including privacy and image rights.

We may refuse, remove or stop processing content that breaks these rules, and suspend or close accounts that do. Where content clearly breaks the rules, no refund is owed.

4. Your content

You keep the rights you have in your photo. You give us a limited licence to store, process and send it to our AI providers, only to make your preview and video and to run the Service, for as long as we keep it (see the Privacy Policy).

You may use the videos you make for personal, non-commercial purposes, such as showing them to your family and sharing them with friends. Room photos are deleted after 7 days and videos after 30 days, so save anything you want to keep.

5. Sharing

Videos are private until you create a share link. Anyone with the link can watch the video, including the "Santa is calling" version, until you turn sharing off or the video is deleted. Copies that people download or re-post are outside our control.

6. Credits and payment

• Credits are sold in one-time packs. There's no subscription and nothing renews.
• Credits don't expire while the Service operates. They have no cash value and can't be transferred.
• Each video uses the credits shown before you make it. Prices may change, but changes never affect credits you already have.
• If a video fails, its credits are returned automatically.
• Payments are processed by Stripe. Prices are in US dollars.

7. Refunds

Refunds follow our Refund Policy: failed videos are refunded automatically, a mispronounced name gets a free redo, and unused packs can be refunded within 14 days. This doesn't limit any rights you have under consumer law where you live. If we close the Service, we'll refund the unused credits you paid for.

8. Reporting misuse

If a video breaks these rules or uses a photo of your home without permission, contact us with the link. We'll review it and take it down when appropriate. Copyright notices follow our DMCA & Takedown process.

9. Availability and changes

We may change, pause or stop parts of the Service, including AI providers. We try to keep it running, especially around Christmas, but we don't guarantee it will always be available or error-free.

10. Disclaimers and liability

The Service and its output are provided "as is". To the extent the law allows, we disclaim implied warranties. We're not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

You're responsible for what you upload and how you use the videos. If your content or use breaks these terms or someone's rights and leads to a claim against us, you agree to cover the resulting costs.

11. Ending your account

You can stop using the Service at any time and ask us to delete your account. We may suspend or close accounts that break these terms.

12. Changes to these terms

We may update these terms. If we do, we'll change the date at the top, and for significant changes we'll tell you before they take effect. If you keep using the Service after that, you accept the new terms.
